How To Properly Document Your Non-Cash Charitable Donations ...

If you want to donate your old stuff instead of having a yard sale, you must make sure that what you want to donate can actually be deducted on your tax return. How do you know? Here?s a simple rule to follow: If you?re unsure whether your item qualifies for a tax deduction, then consider this ? if you would give it to a relative or friend, then the item is most likely in good condition and is appropriate to donate. The official wording from the IRS is this: clothing and household goods must be in ?good used condition? or better in order to qualify for a deduction. The next thing you must do is to determine the fair market value (FMV) of each item. FMV is simply what the item is worth if you were to sell it in a true arms-length transaction between a willing buyer and a willing seller. In other words, what would the item cost if you were to buy (or sell) it in a yard sale, church rummage sale, or at your local Goodwill Industries thrift shop? Obviously, coming up with the FMV can be a challenge. So don?t just ?wing it.? Instead, get some help. An excellent resource is the Goodwill Industries, which has a free publication called ?Valuation Guide for Goodwill Donors.? Free copies of this document are available for download at the Goodwill Industries website. Goodwill?s ?Valuation Guide? is quite helpful for the following reasons: 1. It gives you a great list of the most common items that are potential donations. There are two general categories: 1) Clothing and Accessories and 2) Household and Miscellaneous Items. You definitely want to go through this list to get ideas on what you can donate. It?s easy to overlook things that you might otherwise ignore as possible donations. For example, under clothing and accessories, there are several sub-categories, such as tops, bottoms, dresses, suits, sweats, sleepwear, outerwear, swimwear, shoes, hand-carried items, and belts. Then under each of these sub-categories you?ll find more sub-categories (should I call them sub-sub-categories?). So for ?tops? you?ll see shirts/blouses, sweaters, t-shirts, tanks, and vests. And on and on it goes. 2. This list also provides price ranges for every line item, again with sub-categories for women?s, men?s and children?s clothing items. Within each sub-category is a ?low-high? price range. For example, under women?s shirts/blouses there?s a price range of $2-$12. So here?s where you just want to use some common sense. A very old women?s blouse would be closer to the $2 value; a newer, more fashionable blouse could be worth the high end of the range. The Salvation Army website also has an excellent resource for determining FMV. It?s called the ?Donation Value Guide? and it includes several categories that are not found in the Goodwill Industries ?Valuation Guide?, such as appliances, automobiles and Furniture. So if you have any of those ?big ticket? items, be sure to get some guidance here. Once you?ve got all your stuff organized, simply go through your piles and make a list of each item and it?s FMV. This list doesn?t have to be fancy. You can do it on your computer in a word processing or spreadsheet program. Or just dedicate a 3-ring spiral notebook to this record-keeping chore. But you?ve got to have a detailed list showing each item donated, just in case the IRS audits your return and asks for documentation. And when I say that the list doesn?t have to be fancy, here?s what I mean. The list only needs two columns: Column 1 for a brief description of the item; and Column 2 for the FMV. If you?ve got more than one of the same item, you can get more detailed in your description. Example: ?blue blouse? on one line and ?red blouse? on the next line. Get the idea? Don?t make this complicated. It?s not rocket science. It?s a list. And taking a few minutes to make this list before you donate the items will audit-proof your return and give you no reason to fear should the IRS request documentation.

John Mayer Snags #1 Debut With Born And Raised

The new-and-improved John Mayer appears to agree with his fans, since the formerly mouthy guitar-slinger's latest, Born And Raised
, will debut at the top of the Billboard 200 next week. Mayer's fifth solo disc will become his third to come in at the top of the charts thanks to sales of 219,000, according to figures provided by Nielsen SoundScan.

Well behind him was Adele, whose 21 continues to astonish, moving nearly 56,000 copies in its 66th week on the charts. In fact, since its February 2011 release, 21 has only fallen out of the top 5 one time on its way to more than 9.2 million in sales.

The top 10 also saw the debut of the latest solo effort from guitar hero Slash, Apocalyptic Love (#4, 38,000), Christian rockers MercyMe, Hurt & the Healer (#7, 33,000) and singer/songwriter Sara Bareilles, Once Upon Another Time (#8, 31,000). The rest of the top 10: Carrie Underwood, Blown Away (#3, 45,000), One Direction, Up All Night (#5, 37,000), Lionel Richie, Tuskegee (#6, 33,000), NOW 42 (#9, 31,000) and Norah Jones, Little Broken Hearts (#10, 28,00).

It was a big tumble for former "American Idol" runner-up Adam Lambert, whose second major-label album, Trespassing, slipped 71 percent in its second week and 10 spots to #11 on sales of 22,000, while "Idol" finalist Haley Reinhart's debut, Listen Up! debuted at #16 (20,000). Both had better weeks than Lambert's former rival, "Idol" champ Kris Allen, who showed up at #25 with his second album, Thank You Camellia (16,000).

Elsewhere, Gotye pal Kimbra broke into the charts at #13 with Vows (22,000) and joke rock duo Tenacious D had one of the week's biggest drops, with Rize of the Fenix sinking 24 spots from its debut to #28 (14,000). In the wake of Robin Gibb's death
 fans were motivated to check out Ultimate Bee Gees, which had a 291 percent sales increase to enter the charts at #47 on sales of just under 9,000. Another Brothers Gibb compilation, Number Ones, charted at #68 (7,000).

Website lets you say it with galaxies

The My Galaxies website can be used to render any message using actual pictures of galaxies.

Want to see your name up in lights? How about harnessing galaxies to send a message? There's a website for that, thanks to University of Nottingham astronomer Steven Bamford and Galaxy Zoo's legions of virtual sky-searchers. "My Galaxies" lets you spell out anything you want, using real galaxies that are shaped like characters.

It's clear that Bamford's a character as well, judging by his blurb explaining what the project is all about. Galaxy Zoo participants have classified nearly a million galaxies from the Sloan Digital Sky Survey, based on their shapes, and it turns out that some of those shapes happen to look like letters of the alphabet.


"Really?" Bamford asks rhetorically. "There are galaxies that look like letters? OK, S and Z I can believe, but M? H? R? Capitals or little letters? What about punctuation, or numbers? ... Well, there aren't many, but when you've got pictures of millions of galaxies and an energetic group of Zooites, there isn't much that can stay hidden!"

Zooites began using the odd-shaped galaxies for their own custom-made messages, and eventually Bamford and a colleague of his wrote a Web-based computer program to translate typed messages into Galaxese. T-R-Y ?I-T ?O-U-T!

Are you networking to grow your business? Are you constantly looking for more prospects? If you're wearing yourself out attending scores of networking events and still have very little to show for it, it's time to try something else.

A good way to get started is by learning from your mistakes...

How many of these five mistakes are YOU committing on your quest for more sales leads?

* You go to networking events "expecting" to find clients. * You try to pass out as many business cards as possible at every opportunity. * You don't like to waste time with 'chit chat' and instead tell people about what you have to offer as soon as possible. * You try to close the sale right then and there -- after all, you may not have another opportunity. * You follow up with everyone, making them an enticing offer they can't refuse -- and are puzzled that they decline anyway.

So what should you do instead?

1. If you're going to networking events focusing on getting clients, you'll miss out on what you COULD find: connections.

Focus on getting to know people instead. They may not buy your product today, or ever, but in time they may send numerous people your way who could - but not unless you develop a relationship with them.

2. If you think passing out business cards is a numbers game, you're sadly mistaken.

Instead, focus on getting to know people -- and get their cards as well. Quality is far more important than quantity. Make sure that you have made enough of a connection that people actually remember you when you call later or see them next time -- and remember you in a positive light.

3. Don't jump in with your offer.

Instead focus on the other person, get to know more about them and their business. Start by building rapport and connections. Try and find ways that you can be of service or help them, make introductions and refer them if you can. Ultimately, just get to know them.

4. The hard sell is dead.

If you want to chase away prospects, this is exactly how to do it. It's ok to talk about what you do or offer, the problems you solve and outcomes your clients get. Where you cross the line is when you assume what you do is what they need and start selling and pushing your product or service on them.

If the person you're talking to is interested in your services - schedule a sales appointment. You'll be much more likely to make the sale once you've established a relationship.

5. When you follow up with people after networking events, don't start selling them.

Again, develop the relationship by finding out more about them, seek to be of service and continue to build that relationship. If your follow-up is by email - don't send a sales pitch. Instead reference a point in your conversation and offer them something of value - an informational article, resource link or introduction.

Keep thinking about ways to build "relationships" and be of service. You'll find your networking will start yielding more connections, friends, referrals and opportunities!

Credit Scores for Auto Loans Drop to Near Pre-Recession Levels

Credit scores for consumers purchasing a vehicle have dropped to near pre-recession levels, according to Experian Automotive.

The average credit score for financing a new vehicle dropped six points to 760 and dropped four points to 659 for used vehicles, according to 1Q12 results. In 1Q08, credit scores were at an average of 753 for new vehicles and 653 for used, according to Experian?s quarterly automotive credit analysis.

Interest rates were lower year-over-year, and loan terms were longer last quarter. The average interest rates on new-vehicle loans dropped to 4.56%, down from 4.83% in 1Q11. For used-vehicle loans, the average for 1Q12 was 9.02%, down from 9.08% the previous year. The average loan terms also increased, extending by one month for new and used vehicles to a total of 64 and 59 months, respectively.

The analysis also showed an increase in the average amount financed. The average amount financed on new vehicles rose $589 in 1Q12, reaching $25,995. For used vehicles, the average amount financed increased $411 to $17,050.

Men, Women & Communication Breakdown - Business Networking ...

This blog is an excerpt from the book Business Networking and Sex (not what you think),?the book I co-authored with Frank De Raffele and Hazel Walker.? Enjoy!

Bill asks Candace out on a date. They have a great time. They then start to date regularly.

Six months later, while driving home from their dinner date Candace says, ?Do you realize that tonight is our sixth-month anniversary?? For a few seconds, there is silence in the car and to Candace it seems like deafening silence. She thinks to herself, I wonder if it bothers him that I said that. Maybe he?s been feeling confined by our relationship. Maybe he thinks I?m trying to push him into some kind of obligation that he doesn?t want, or isn?t sure of.

Meanwhile, Bill is thinking, Hmmm, six months.

Candace is percolating away in her head with, But, hey, I?m not so sure I want this kind of relationship, either. Sometimes I wish I had a little more space, so I?d have time to think about whether I really want us to keep going the way we are, moving steadily forward. Where are we going with this thing, anyway? Are we just going to keep seeing each other at this level of intimacy? Are we heading toward marriage? Children? An entire lifetime together? Am I ready for that level of commitment? Do I really even know this person?

At this point Bill is thinking, So that means it was . . . let?s see . . . February when we started going out, which was right after I had the car at the dealer?s, which means . . . lemme check the odometer . . . Whoa! I?m way overdue for an oil change!

Candace is now at the point where she?s thinking, He?s upset. I can see it on his face. Maybe I?m reading this completely wrong. Maybe he wants more from our relationship, more intimacy, more commitment. Maybe he?s sensed it, even before I did, that I had some reservations. Yes, I?ll bet that?s it. That?s why he?s so reluctant to say anything about his own feelings. He?s afraid of being rejected.

Bill is thinking, Yeah, and I?m gonna have them look at the transmission again. I don?t care what those morons say, it?s still not shifting right. And they better not try to blame it on the cold? weather this time. What cold weather? It?s 87 degrees out, and this thing is shifting like a garbage truck, and I paid those incompetent thieves $600.

Candace is thinking, He?s angry. And I don?t blame him. I?d be angry, too. I feel so guilty, putting him through this, but I can?t help the way I feel. I?m just not sure.

Bill is thinking, They?ll probably say it?s only a 90-day warranty. That?s exactly what they?re gonna say, the scum.

Candace is thinking, Maybe I?m just too idealistic, waiting for a knight to come riding up on his white horse when I?m sitting right next to a perfectly good person, a person I enjoy being with, truly do care about, and who seems to truly care about me. And now this person is in pain because of my self-centered, schoolgirl romantic fantasy.

Bill is thinking, Warranty? They want a warranty? I?ll give them a warranty. I?ll take their warranty and?

?Bill.? Candace says aloud.

?What?? answers Bill, startled.

?Please don?t torture yourself like this.? she says, her eyes beginning to brim with tears, ?Maybe I should never have. . . Oh, I feel so. . .?

She breaks down, sobbing.

?What?? Bill asks, wondering what just happened.

?I?m such a fool.? Candace sobs. ?I mean, I know there?s no knight. I really know that. It?s silly. There?s no knight, and there?s no horse.?

?There?s no horse?? says Bill and wonders, What horse?

?You think I?m a fool, don?t you?? Candace asks in self-blaming tone.

?No!? says Bill, thinking, Why should I?

?It?s just that . . . it?s that I . . . I need some time.? Candace says.

Dead silence again. Bill is trying to find what the right answer is here. Finally he comes up with one that he thinks might work.

?Yes,? he says.

Candace feels so touched that she puts her hand on his.

?Oh, Bill, do you really feel that way?? she says.

?What way?? says Bill, thinking, What are we talking about?

?That way about time?? asks Candace.

?Oh.? says Bill. ?Yes. Of course.?

Candace turns to face him and gazes deeply into his eyes, causing him to become very nervous about what she might say next, especially if it involves a horse. At last she speaks.

?Thank you, Bill.? she says, lovingly.

?Thank you.? says Bill, thinking, Whew. Got that one right.

Then he drops her off at her house where she lies and weeps on her bed, a conflicted, tortured soul, whereas Bill back at his place opens a bag of Doritos, turns on the TV, and immediately becomes deeply involved in a rerun of a tennis match between two Czechoslovakians he?s never heard of.

A tiny voice in the far recesses of his mind tells him that something major was going on back there in the car, but he?s pretty sure there is no way he would ever understand what, so he figures it?s better if he doesn?t think about it.

Candace?calls her closest friend and they talk about this situation for two hours. They analyze everything she said and everything he said, going over it many times, considering every word, expression, and gesture for nuances of meaning, and any possible ramifications. They?ll continue to discuss this subject, off and on, for weeks, maybe even months, never reaching any definite conclusions, but never getting bored with it, either.

Meanwhile, Bill,?as he plays?plays racquetball one day with a mutual friend of his and Candace?s stops before shooting a basket and says, ?Steve, did Candace ever own a horse??

Have you ever thought of yourself as a networker? Do you know exactly what a networker is or does? Does networking appear to be something which solely those top exec businessmen and girls do? A business network is a type of social network whose reason for existing is business activity.'

Why is it much better than online searches?

Networking is way better method to search for jobs compared to online searches or looking through job listing for several reasons, here are a few:

o Most business employers will hire via referrals first before advertising on the web

o Individuals working in the organization will most likely know of a position ahead of the position becoming available.

o When networking, those who work in the company will be able to refer you to the appropriate people to speak to.

o People are more likely to have confidence in someone they'vemet than an individual they've never met.

Where can one network?

Networking opportunities are everywhere truly. You can start a discussion on the bus with someone who could know of a position available for you. That is why it is best to be open for opportunity without seeming desperate for jobs. Participating in industry conferences is another method to source good contacts. Social networks are a great way to find more job leads. Facebook, Twitter and LinkedIn allows you to meet with people within your field on a more substantial scale.

How can you become a networker?

James scores 32 as Heat run past Celtics in Game 1

MIAMI (AP) ? The way LeBron James and Dwyane Wade are rolling right now, one bad quarter is hardly too much for the Miami Heat to overcome.

And with that, the Heat are three wins away from another trip to the NBA finals.

James scored 32 points and grabbed 13 rebounds, Wade scored 10 of his 22 points in the fourth quarter and the Heat beat the Boston Celtics 93-79 on Monday night in Game 1 of the Eastern Conference finals.

"One down. And they still have an opportunity in Game 2 to accomplish what they want to," Heat coach Erik Spoelstra said, referring to how Boston can still grab home-court advantage by winning Game 2. "At times it was a strange game. Some good runs, both teams. We felt we could have played better and I'm sure they felt the same thing. But we found a way to grind it."

Shane Battier, playing in the conference finals for the first time, had 10 points and 10 rebounds for the Heat, who wasted an early 11-point first-half lead, then gave up 35 second-quarter points before running away to break a halftime tie ? getting going with a 9-2 run early in the third.

Miami outrebounded the Celtics 48-33, blocked 11 shots and didn't trail at any time.

"A block is like a dunk," Wade said. "It gets your team going."

Kevin Garnett had 23 points and 10 rebounds for Boston, which got 16 points, nine rebounds and seven assists from Rajon Rondo and 12 points from Paul Pierce. Ray Allen shot just 1 for 7 from the floor for Boston, which was outscored by 10 in the first quarter and 11 in the third.

"On the road, you can't have two quarters of lulls," Celtics coach Doc Rivers said.

Game 2 is Wednesday night in Miami.

And while both sides would say there's a long way to go in this series, Game 1 winners have a decided edge in any best-of-seven, the conference final being no exception. In the most recent 10 postseasons, teams with 1-0 leads in conference finals have advanced 15 out of 20 times.

James and Wade scored 197 points in the final three games of Miami's second-round series with Indiana, all those games being Heat wins. The momentum carried over into Game 1 with the Celtics.

"We get a lot of the press, we get a lot of the headlines," James said. "But our teammates, they do everything to help us win ball games."

It's the third straight year the Heat and Celtics have met in the playoffs, and the third straight year James has seen his postseason path go through Boston ? the first of those matchups coming in 2010 in his final run with Cleveland.

Each of those came in the first or second rounds, not this close to the NBA finals. And yes, the rivalry seems to be heating again.

"They're home, they're comfortable and when you're comfortable you do things like that," Garnett said, suggesting that Miami was showboating at times down the stretch. "We have to show them to take them out of their comfort zone. We've got to fight a lot harder."

Last season's Miami-Boston series ended with James scoring the final 10 points of Game 5, and the start of this year's matchup had him putting on another offensive display.

He had 13 points in the first quarter ? two more than the entire Celtics roster ? and Miami ran out to a 21-11 lead after the opening period. Garnett made three of his four shots in the quarter, while everyone else in Boston green was 2 for 16 from the floor.

"I thought they were ready to play," Rivers said. "I'm talking about Miami. I thought we kind of joined the game."

The 11 points matched the lowest output by any team in the opening quarter this postseason. The other team to manage that few was San Antonio, which then dropped 32 on the Los Angeles Clippers in the second quarter of their game on May 19.

The Celtics' response was even better.

Boston scored 35 in the second quarter, erasing what was an 11-point deficit early in the period by scoring 27 points in the final 8:46 of the half to pull into a 46-all tie. Rondo, Garnett and Pierce combined to score 23 points in the quarter, looking absolutely vintage, near-perfect offensive execution getting to Miami time and time again.

And the Celtics' comeback happened even while they got hit with three technical fouls in the second quarter, plus Allen missing four first-half free throws ? matching his career-worst for an entire game.

"We may never see that again," Rivers said.

In the end, it went down as merely a one-quarter lapse for Miami.

Another technical foul, this one on Rondo, came in the third quarter, likely born from frustration as the Heat started to roll again.

With the game tied at 50, Rondo missed three shots in a 31-second span early in the third, the last of those getting blocked by Battier ? who hit a 3-pointer 11 seconds later. It started a 9-2 Miami burst, including a touchdown pass from Wade to James ? Wade grabbed the rebound of a miss by Pierce, spun and delivered a 90-foot pass to the reigning MVP ? for an easy score.

"We knew at halftime we hadn't played our best basketball," James said. "So we just had to stop making the mental mistakes and start to play the way we're capable of playing."

And that's what happened.

Miami led by as many as 13 late in the third, before taking a 72-61 lead into the fourth. James scored 10 more in the third, Boston went cold again, shooting just 27 percent in the period, and Wade's left-handed bullet pass into the lane set up Joel Anthony for a dunk that pushed the Heat lead to 15 with 10:13 remaining.

Pierce was 5 for 18. Rondo shot 8 of 20. Ray Allen was 1 for 7 from the floor and 3 for 7 from the foul line ? missing four free throws for just the third time in his 1,270 career regular-season and playoff games.

"We kept fighting," Rondo said. "It wasn't pretty. We missed four or five layups, a bunch of free throws. That being said, we were tied at halftime but we just didn't come out with the right mindset in the second half."

Miami did and takes a 1-0 lead into Game 2 as its reward. But James said he knows Boston is far from done.

"I look at them as a top opponent, as a top contender and a competitive group ... a championship-caliber team," James said.

NOTES: Spoelstra is now 6-0 in Game 1s at home. ... James passed Sam Jones (2,909) for 22nd on the NBA's playoff scoring list with a layup late in the first quarter, and Garnett passed Dirk Nowitzki (1,314) for 22nd on the league's postseason rebound list. ... "Headhunters" is a bit like an Ikea desk assembled with your nondominant arm -- sleek and attractive, but likely to fall to pieces if you look at it too hard.

"Headhunters" will indeed hand you your head.

A cat-and-mouse game with the giddy excitement of a heist movie.

It's crisp entertainment even as plot absurdities gum up the works - you can almost hear the pages turn as you watch.

The scenes of graphic violence are drawn out to the point where they overwhelm the story.

Sleek and relentless, it's a provocative, darkly comedic thriller.

Suspenseful, wickedly funny and clever, Headhunters offers more bang for your buck than most modern crime thrillers.

"Headhunters" isn't a pretty film, and it doesn't always entirely make sense, but it races along like a man chased by killers.

The good guy in the Norwegian "Headhunters" looks like a bad guy, and the bad guy looks like a good guy. And that's just one of the ways this dazzling movie messes with us.

HEADHUNTERS is an exhilarating thriller with great visual flare, top notch acting, and a story that will have you so involved that you'll possibly have no fingernails by the end of it!

Like a Teutonic techno band, this thriller is both skillfully familiar and chillingly strange.

...a sordid blast of delirious violence, brutal corporate satire, and male inadequacy.

This is one funny, gory, high-class crime thriller and my favorite Norwegian export since 'Troll Hunter.'

Do yourself a favor and see this one before some Yank director gets it all wrong.

Headhunters is a slick entertainment with well-orchestrated chases and bloody shootouts, though its characterizations are shallow and sketchy.

Despite the gaps in logic the movie...is cannily put together and easily holds your attention.

TV Networks File Legal Claims Saying Skipping Commercials Is Copyright Infringement

Okay, we had?expected?the TV networks to possibly take legal action against DISH Networks for its new Auto Hopper technology, which allows DISH subscribers who use the Hopper feature (which records all prime time shows from the four major networks) to autoskip commercials, if they watch shows in the days after they originally air. It wasn?t a surprise that the TV networks didn?t like?this at all, but could they really make a?legal?argument that skipping commercials was against the law? We?ve all heard the story of former Turner Broadcasting exec Jamie Kellner claiming?that not watching commercials was ?theft,? but do the networks actually think there?s a legal basis for such claims?

It appears they do. Though, the legal arguments are?insane.

As you may have heard by now, Fox, CBS and NBC Universal?have all sued DISH in California. At about the same time, DISH itself filed for declaratory judgment in New York against those three, and ABC, who hasn?t yet filed suit, but perhaps will shortly. I would imagine that all of the cases will be consolidated in one of the courts.

What?s scary, however, is that the TV networks appear to be using this lawsuit to claim that skipping commercials is copyright infringement.?I haven?t yet seen the NBC filing, but the Fox and CBS filings both make this same basic argument.?Update: NBC filing is added below, and is nearly identical to the CBS filing, down to the very same lawyers. Fox first argues that merely recording the entire prime time lineup is making ?bootleg? copies of the videos. That?s a rather stunning claim, and a?direct?challenge to the Supreme Court?s ruling in the?Betamax case, which made it clear that time-shifting is legal. The networks are claiming that this is not the same thing, because the ?copies? aren?t being made by the user, but by DISH itself for use by the user. Beyond being a meaningless distinction, it?s also not true. As the Cablevision case concerning a ?remote DVR? offered by the service provider showed, if the actions are at the request of the consumer, then it?s?the consumer?making the call. With the DISH offering, the subscriber is still the one pushing the button and asking the DVR to record the shows. Is it really that different that it takes one button rather than punching in a few shows? That would be extraordinary ? but these filings are full of such extraordinary claims.

Where the filings go really off the wall is in basically saying that skipping commercials is infringement. They do this in the sections on ?inducement,? wherein they suggest that, even if DISH doesn?t directly infringe, it is is inducing infringement by offering the auto commercial skip feature to users. From the CBS filing:

Users of the Hopper?s PrimeTime AnyTime feature who record Plaintiff?s prime-time shows and use the Hopper?s Auto Hop feature to automatically skip commercials otherwise contained in those recordings infringe Plaintiffs? exclusive reproduction rights under section 106 of the Copyright Act,

But this makes no sense. Recording the show for later viewing is?already deemed legal. So the only difference here is?the intent?of the user to watch later to skip commercials. Thus, CBS seems to be saying that merely wanting to avoid commercials?is, itself, direct copyright infringement. And, given that Auto Hop doesn?t work until the day after the shows air, does that mean that it?s legal to record the shows if you intend to watch them the same day? but the second your?intention?is to watch them later, it?s copyright infringement? That makes no sense and has absolutely no basis in the law. And, uh, what happens if you record it with the intent to watch the next day and skip commercials? but then watch it the same day with the commercials? The allegation above says merely recording the shows with intent to skip commercials is infringement, even if you don?t actually skip the commercials! That makes no sense.

Fox?s filing makes similar claims, insisting that DISH is inducing infringement because it ?took active steps to encourage its subscribers to use Primetime Anytime to infringe FOX?s copyrights.? But that?s flat out malarkey. It?s?legal?for users to time shift shows. That?s established. Yet, these filings seem to want to?totally ignore that, and then assume that a user watching a DVR?d s how is automatically infringing on copyright because they might skip commercials.

The argument makes absolutely no sense at all. Effectively, the networks are trying to claim inducement to infringe? but do not (and, indeed, can not) show what or who is actually infringing. Time shifting is legal. Not watching commercials is legal. So, er, where?s the copyright infringement, unless you completely throw out the Betamax ruling?

The filings also go down the path of explaining how this disrupts their business model. They honestly seem to be arguing for what some people have amusingly referred to as??felony interference with a business model.??They list out all the different ways they get companies and users to pay multiple times for the same content, and use that to suggest this must be illegal, even though DISH has a retransmission license and all the individual parts are legal. I honestly don?t understand this argument ? they?re just claiming that because they don?t like how end users engage with otherwise legal content, it must be illegal. Fox even uses this to claim that DISH?s offering is?not??enhancing consumer choice.? Apparently, in the minds of TV network lawyers, what counts as ?consumer choice? is limited to what the TV networks want to count as consumer choice? and any other choices are no choices at all. Or something.

There are a few slight differences in the lawsuits. For example, Fox brings up the fact that DISH also offers the Slingbox to allow users to not just time-shift but also place shift, though fails to explain why that?s an issue at all. Fox also includes a breach of contract claim, which also may be difficult to support if all of the other actions prove to be legal.

DISH?s declaratory filing gives you a pretty clear sense of that company?s argument, pointing out that this is a nice feature that consumers want, that this kind of technology is already widely in use, and that it?s not clear how any of this is infringement.

Auto Hop is a more efficient way of achieving what consumers already do with standard DVRs. A 30-second skip feature is already standard on many DVR remote controls. It permits viewers to automatically skip ahead in a recording, at the touch of a button, completely bypassing a typical 30-second television commercial. The remote controls that come with DVRs supplied by Comcast, an NBC affiliate, can be programmed to include this 30-second skip feature. DISH has provided a 30-second skip feature for years. By pressing the 30-second skip button multiple times, a viewer can elect to bypass the full complement of commercials between show segments. Now, DISH allows the customer to opt to use an Auto Hop feature that is just an extension of this 30-second skip function. It avoids the common frustration that occurs when viewers, using the 30-second skip or plain fast-forwarding, overshoot the commercials and fastforward into the television programming content that they really want to watch.

DISH also points out that skipping commercials is not illegal:

DISH?s Auto Hop feature promotes consumer autonomy. Viewers have skipped commercials for decades. Viewers commonly use the commercial break as a time to get up and momentarily leave the room. Ever since the advent of the remote control, viewers have changed channels or muted the sound during commercial breaks. And, since the advent of the VCR and DVR, viewers playing back a show have fast-forwarded through commercials. DISH is simply making it easier for viewers to refuse to be a captive audience and to exercise the well-accepted choice to skip a commercial.

I can?t see how the networks? argument can stand very much legal scrutiny at all ? but stranger things have happened when copyright cases hit the court. Still, the arguments here are so bizarre, and so unsupportable, you have to believe a judge will reject them quickly.

UMD's Williams Qualifies for NCAA Finals

Pueblo, CO (Northland's NewsCenter) --- UMD senior runner Lexi Williams qualified for the finals in the 800-meter run on Friday night, finishing eighth in her heat at the Division II NCAA outdoor track and field championships.

Williams ran the race in 2 minutes, 10.72 seconds to put her through to Saturday's championship race, with that scheduled to be run at 5:55 p.m. CST.

The Rice Lake native is making her first-ever appearance the NCAA championships, and she is one of only two UMD runners to qualify this year for the national meet.

As a strategic planning facilitator, have you taken a look at how you use projector and remote? If not, then you should start now. A lot of facilitators think that projector is just a means to an end and that the only function it serves is to make sure you have means to show what's on your computer screen. This is true to a certain extent, since obviously projecting is its primary goal. Using it effectively in facilitating is a different thing all together though.

Checking your projector before a session is part of effective planning. It is always advisable to enter the conference or training room early so that you can at least check that the projector is working. Most projectors take around three minutes before they warm up so coming in right on time means you will have to spend the first couple of minutes of your session waiting for the projector to turn on.

Once you have switched the projector on, you should check your remote control next. As a strategic planning facilitator, it's important for you to know how to use the remote control correctly. In some locations, the standard sized remote control may have already been replaced by small finger-sized usb remote that you have to plug into your computer.

A standard projector control has a couple of basic functions. The first is to freeze your screen. At some time during your presentation, you might need to open up another screen for example. Instead of having to make your participants see the rest of your screen, you can freeze it and all the participants will see is the screen you were last on. The projector remote will also have a button to choose input options. If you use two computers as a lot of facilitators do, you have the capability to switch screens right from the projector.

Other than those buttons, most remote controls also have mouse buttons. These mouse buttons will allow you to move through presentations without having to go back to your pc. The advantage of this is that you don't have to walk from one location to another - a hassle when your facilitator training area is far from the computer you are using.
